EU adopts OPA 90

, the EU has proposed a ban on older, single-skinned tankers in line with OPA 90. In addition, it wants to ban any vessel over 15 years old that has been detained twice by port state control officials in the preceding two years ? a blacklist will be published twice a year.

OPA 90 bans single skinned tankers over 25 years old and all single hull tankers will be banned by 2010 ? the situation on HBL and other alternatives is unclear. For vessels with either a double bottom or double sides, the limit is 30 years with a cut off of 2015.

Also proposed is more thorough control of class societies and the EU is reserving the right to suspend or withdraw a society?s recognition using simplified procedures. It says that class must adopt more stringent quality criteria and must be held fully liable in the event of negligence.

In adopting the proposals the EU said: “The application of the current international legal framework ? including IMO rule ? falls short of providing an adequate response to maritime safety.” It is now up to the government in each member state to pass the necessary legislation.
